1. Parties and Scope
These Terms of Use ("Terms") govern the relationship between you ("User", "you") and Spark AI ("we", "Company") regarding the Spark AI / Kıvılcım AI mobile application ("App") and related services ("Service"). By using the App, you agree to these Terms.
2. Service Description
Spark AI provides AI-powered solution, planning, mock exam, tracking, and content summarization tools for students preparing for university entrance exams (YKS / TYT / AYT and similar). The Service is for informational purposes only and does not guarantee academic results.
3. Account and Age Requirement
- You must be at least 13 years old to use the App. Users under 18 should use the App with parental / guardian consent.
- You are responsible for the security of your account and password.
- Providing false information or accessing another user's account without permission is prohibited.
4. Paid Subscriptions and Trial
- New users receive a 3-day free trial with full app access.
- At the end of the trial, you may choose a Premium plan (monthly, annual, or lifetime) to continue.
- All payments are processed via Apple App Store / Google Play; cancellation, refunds, and billing follow the respective platform's policies.
- Auto-renewing subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period. You may manage / cancel via your App Store / Play Store account settings.
- Attempts to abuse the trial (e.g., repeated reinstallation, fake accounts) may be blocked by the system.
5. Use of Artificial Intelligence
Solutions, plans, and feedback within the App are produced by AI models. Such content:
- May contain inaccurate, incomplete, or outdated information.
- Is not a substitute for official exam rules or authoritative sources.
- Should not be the sole basis for important decisions (exam strategy, university choices, etc.).
You are responsible for verifying the accuracy and suitability of AI output.
6. Acceptable Use
The following are prohibited:
- Reverse-engineering, decompiling, or copying the App.
- Accessing the Service via automated means (bots, scrapers).
- Uploading copyrighted or illegal content.
- Harassment, hate speech, or discrimination toward other users.
- Actions that harm the Service infrastructure.
7. User Content
You retain ownership of photos, questions, and notes you upload. You grant us the right to process, store, and feed such content to AI models for the purpose of delivering the Service. See our Privacy Policy for details.
8. Intellectual Property
The Spark AI brand, logo, source code, and all design elements within the App belong to the Company. They may not be copied or distributed without explicit written permission.
9. Disclaimer of Warranties
The Service is provided "as is". We do not guarantee uninterrupted, error-free, or fully secure operation. To the maximum extent permitted by law, the Company is not liable for indirect damages (data loss, lost profits, exam failure, etc.).
10. Modification or Termination of Service
We reserve the right to change, suspend, or terminate the Service or specific features without prior notice. Refunds for unused subscription periods follow Apple / Google policies.
11. Account Closure
You may close your account at any time via in-app Profile → "Delete my account". The Company may suspend or close accounts that violate these Terms.
12. Governing Law and Disputes
These Terms are governed by the laws of the Republic of Türkiye. Disputes will be resolved by the courts and enforcement offices of Istanbul (Çağlayan). Consumer rights to apply to consumer arbitration committees and consumer courts remain reserved.
13. Changes
These Terms may be updated from time to time. Significant changes will be announced in-app or by email. The current version is always available on this page.
